NOTICE OF PUBLIC SALE OF COLLATERAL
PLEASE TAKE NOTICE, that in accordance with applicable provisions of the Uniform Commercial Code as enacted in New York, 37-10 114TH Street ML Funding LLC, a Delaware limited liability company (“Secured Party”), will offer for sale, at public auction, all of CHATUS MEZZ (DE) LLC’s (the “Debtor”) right, title and interest in and to (a) 100% of the membership interests of SAMCOM 48 (DE) LLC (the “Pledged Entity”), and (b) certain related rights and property relating thereto (collectively, (a) and (b) are the “Collateral”). Secured Party’s understanding is that the principal asset of Pledged Entity is the parcels of real property commonly known as the Holiday-Inn-Express LaGuardia located at 37-10 114th Street, Corona, New York. The public auction will be held on June 7, 2021 at 12:00 p.m., New York time, by remote auction via the Cisco WebEx Platform or web-based video conferencing and/or telephonic conferencing program selected by Secured Party. The Collateral will be sold to the highest qualified bidder; provided, however, that Secured Party reserves the right to cancel the sale in its entirety, or to adjourn the sale to a future date. The sale will be conducted by Mannion Auctions, LLC, by Matthew D. Mannion, Auctioneer, NYC DCA License No. 1434494, with offices at 305 Broadway, Suite 200, New York, New York. The Collateral will be sold as a block, and will not be divided or sold in any lesser amounts. Upon execution of a standard non-disclosure agreement, additional documentation and information will be available. Interested parties who do not contact the Secured Party and qualify prior to the sale will not be permitted to enter a bid.
